EB-1B vs. EB-1A
Both lead to green cards, but EB-1B is designed for academics.
| Feature | EB-1A | EB-1B |
|---|---|---|
| Who | Any field | Professors/researchers only |
| Experience | No minimum | 3+ years required |
| Job Offer | Not required | Required |
| Criteria | 3 of 10 | 2 of 6 |
Which to Choose?
Choose EB-1B if you have a tenure-track position or permanent research role at a U.S. university. Fewer criteria (2 of 6 vs 3 of 10) and designed for academics. Choose EB-1A for more flexibility or if you don't have a job offer yet.
The 6 EB-1B Criteria
Meet 2 of these 6 criteria. Academic-focused, more achievable than EB-1A.
1. Academic Awards
Prizes for outstanding achievement in your field
Examples that qualify:
- Best dissertation award from academic society
- NSF CAREER, NIH K99, ERC Starting Grant
- Best paper awards at conferences
- Competitive fellowships (Fulbright, Marie Curie)
USCIS Guidance
Awards must recognize outstanding achievement. Competitive fellowships with selection committees qualify. General funding without competition doesn't.
2. Professional Memberships
Membership requiring outstanding achievements
Examples that qualify:
- IEEE Fellow, ACM Senior Member
- Learned societies requiring peer election
- Honor societies with selection criteria
- Academies with demonstrated excellence requirement
USCIS Guidance
Must require achievements beyond dues. Include invitation letters and selection criteria documentation.
3. Press About Your Work
Publications written by others about your research
Examples that qualify:
- University press releases picked up by media
- Research featured in Science/Nature news
- Interviews in academic or mainstream media
- Research cited in policy documents
USCIS Guidance
Must be ABOUT your research, not authored by you. Even university press releases count if picked up by external media.
4. Judging Work
Reviewing others' work in your field
Examples that qualify:
- Peer reviewer for academic journals
- Grant reviewer for NSF, NIH, DOE
- Conference program committee
- Journal editorial board
USCIS Guidance
Save invitation emails and completed review documentation. Quality of journals/conferences matters.
5. Original Research
Research contributions with demonstrated impact
Examples that qualify:
- Papers with 100+ citations each
- Research leading to adopted methodologies
- Widely-used datasets or software tools
- Research cited in textbooks
USCIS Guidance
Focus on impact metrics. Citation counts, adoption evidence, expert letters explaining significance. Show field-wide influence.
6. Scholarly Publications
Authored articles in professional journals
Examples that qualify:
- First/corresponding author in peer-reviewed journals
- Papers in top conferences for your field
- Book chapters in academic presses
- Well-cited publications
USCIS Guidance
Quality over quantity. 8-12 strong publications with citations better than 40 weak ones. Impact factors and citations matter.
